Case Explores Rights of Fetus Versus Mother

  4. This issue or problem face all pregnant women in the state of Wisconsin.
  5. Why or how does this affect families/individuals? how the rights of pregnant women and legal status of the unborn are proceeded with cases of women who at one time were addicted to drugs.
  6. My views on this issues: After reading about this particular case I was very astonished how Wisconsin's authorities and medical staff acted towards the making of this case. I think the way they went about it is definitely unconstitutional and is a great case for a pregnant woman's rights and also of her medical history privacy and confidentiality. Ms. Beltran who admitted to her physician on her first prenatal visit she was addicted to a pain killer but now has been off of it and is now drug free. Her physician however looked skeptical and unannounced a few days later came a sheriff to remove Ms. Beltran from her home and in front of the court. How does that sound right to you? It is not and according to the state of Wisconsin they have a "cocaine mom" law that pretty much says that any pregnant woman refusing to get treatment for substance abuse can be confined by authorities. I understand if the woman was clearly very pregnant and still doing meth on a street corner then yes by all means confine her but as for this particular case it is very wrong what they did. Ms. Beltran being honest said she has abused but now is sober and urine tests show that there was no trace of the drug after her second test. I just hope Beltran wins this case and they change this law to a better law that will protect your constitutional rights.
